1. The Certifying Mentor
This commitment is executed by Adam Maurer, operating as a Trabalhador Independente under Portuguese law, holding Tax Number (NIF) 302065709, and trading under the commercial brand name Lean Six Sigma Factory (hereinafter referred to as "L6SF" or "the Instructor"), acting as the Lead Instructor, Mentor, and Certifying Authority.
2. Purpose of Disclosure
In order to achieve official Lean Six Sigma Green Belt or Yellow Belt Certification, candidates must submit real-world project documentation, data baselines, value stream maps, and project summaries (the "Project Artifacts") for academic evaluation, mentoring, grading, and final certification sign-off. This Commitment is issued to guarantee that any sensitive business information contained within these student submissions remains strictly confidential.
3. Scope of Protected Information
"Confidential Information" refers to any proprietary business, financial, or operational data belonging to a candidate's employer or organization that is shared with the Instructor during the training or certification cycle. This explicitly includes:
- Lean & Six Sigma Artifacts: Value Stream Maps (VSM), swimlane diagrams, SIPOC structures, Failure Mode and Effects Analysis (FMEA) risk scores, and Standard Operating Procedures (SOPs).
- Process & Data Metrics: Machine or software event logs, historical defect rates, cycle times, Takt times, process capability calculations, and calculated Cost of Poor Quality (COPQ) financial valuations.
- Corporate Data: Internal financial balances, customer lists, software screenshots, and strategic operational bottlenecks.
4. Obligations of the Instructor
The Instructor hereby binds themselves to the following strict standards of confidentiality:
- Academic Review Only: Confidential Information will be used solely for the purpose of mentoring the candidate, reviewing project milestones, and evaluating eligibility for certification.
- Strict Non-Disclosure: The Instructor will not disclose, publish, leak, copy, or distribute any portion of a candidate's project slides, reports, or submitted spreadsheets to any third party without explicit written permission from the candidate's organization.
- Secure Storage: All digital submissions, emails, and project files received from candidates will be stored securely on password-protected hardware or encrypted cloud storage managed solely by the Instructor.
- Anonymization Assistance: The Instructor agrees to allow and encourage candidates to mask, alter, or anonymize sensitive financial numbers, client names, or product codes in their slide submissions, provided the statistical relationship and methodology remain clear for grading.
5. Exclusions
This Commitment does not apply to any information that is or becomes publicly known through no fault or breach of the Instructor, was already lawfully in the Instructor's possession prior to the candidate enrolling, or is required to be disclosed by court order or competent Portuguese public authorities.
6. Term and Data Destruction
This confidentiality commitment is binding from the moment a candidate submits project materials and shall survive the conclusion of the training course for a period of three (3) years. Upon explicit written request by a candidate or their employing organization following final certification grading, the Instructor will permanently delete all local digital copies of the candidate's project workbooks and portfolio submissions.
7. Governing Law and Forum
This Commitment is executed under and shall be governed exclusively by Portuguese Law. Any disputes or legal claims arising out of a breach of this confidentiality duty shall be resolved exclusively in the Judicial Court of the District of Funchal, Portugal, expressly waiving any other forum.
INSTRUCTOR ACKNOWLEDGMENT & VALIDATION
This document serves as a binding legal statement under Portuguese law by the Certifying Authority. No counter-signature is required by the candidate or their employer to activate these protections; they take effect automatically upon the submission of any course materials or data portfolios.
